Welcome to SmartyX (“we”, “us”, “our”).
These Terms of Service (“Terms”) govern your use of the SmartyX website, services, products, monthly plans, and any related tools or materials (“Services”).

By signing up, purchasing a plan, or using any SmartyX service, you agree to these Terms.

If you do not agree, do not use our Services.


1. Description of Service

SmartyX is a done-for-you digital growth service that provides:

  • Professional website design & hosting
  • Google Business Profile setup & optimisation
  • Local SEO improvements
  • Review generation strategy
  • Ongoing support & monthly updates
  • Google Ads / Facebook Ads management (higher plans)
  • Monthly reporting (selected plans)

Services vary depending on the plan purchased.


2. Your Responsibilities

You agree to:

  • Provide accurate business details when requested
  • Supply any required content (logos, service details, pricing etc.)
  • Respond to requests for information when needed
  • Ensure that any content you provide is legal and owned by you
  • Maintain an active payment method for monthly fees

Failure to provide required information may delay or limit service delivery.


3. Payment Terms

3.1 Setup Fees

Some plans include a one-time setup fee, payable at checkout.
Setup fees are non-refundable once work has begun.

3.2 Monthly Fees

Your plan includes a recurring monthly payment processed via GoCardless (Direct Debit) or card.

3.3 Failed Payments

If a payment fails, we may:

  • Pause or disable your website
  • Pause SEO/optimisation work
  • Pause advertising (if applicable)

Your service will resume once payment is completed.


4. Refund Policy

Because our services involve manual work, setup, labour, optimisation and hosting, we do not offer refunds on:

  • Setup fees
  • Monthly subscription fees
  • Advertising spend
  • Completed design or development work

You may cancel anytime (see Section 5).


5. Cancellation

You may cancel your SmartyX plan at any time by contacting us or via your account.

When you cancel:

  • Your Direct Debit subscription will be stopped
  • Your website will remain live until the end of the paid billing period
  • After the paid period ends, your hosting, website, SEO and services will be fully disabled

If you require your website files to migrate elsewhere, a £150 transfer fee applies.


6. Website & Hosting Ownership

  • All website files remain the property of SmartyX until transfer fees are paid.
  • Website hosting is provided only while you remain an active subscriber.
  • You may not copy, clone, resell or replicate our designs or system.

7. Advertising Services (For Growth & Performance Plans)

If your plan includes Google Ads or Facebook Ads management:

  • You are responsible for advertising spend
  • Results cannot be guaranteed
  • We may pause ads if your monthly fee is unpaid
  • Access to your ad accounts may be required

8. SEO & Ranking Disclaimer

While our SEO is proven to improve visibility and ranking, we cannot guarantee specific ranking positions or search results due to factors outside our control, including:

  • Google algorithm updates
  • Competitor activity
  • Location changes
  • Industry regulation

9. Content Restrictions

You may not use SmartyX for:

  • Illegal or fraudulent activity
  • Pornography or adult entertainment
  • Hate speech, violence or discrimination
  • Financial scams, crypto schemes or misleading claims

We reserve the right to terminate accounts that violate these rules.


10. Support & Communication

Support is available Monday–Friday, 9am–5pm (UK time).
Support includes:

  • Website help
  • Technical issues
  • Updates (as per plan)
  • Basic content edits
  • SEO queries

Additional work beyond plan scope may incur extra charges.


11. Limitation of Liability

SmartyX is not liable for:

  • Loss of revenue or business
  • Loss of ranking due to Google changes
  • Data loss not caused by our negligence
  • Issues caused by third-party plugins or platforms
  • Downtime from hosting providers or internet issues

Our total liability will not exceed the amount paid to us in the last 3 months.


12. Changes to These Terms

We may update these Terms at any time.
If changes are significant, we will notify you via email or dashboard.

Continued use of our Services indicates acceptance of updated Terms.
